Variation 13 of Proposed Waikato District Plan and Notice of Requirement for Designation

The Waikato District Council has prepared the following variation of the Proposed Waikato District Plan.


Variation 13 Te Kauwhata Structure Plan: The variation amends rules and maps in the Proposed District Plan to manage the impacts of the expected growth and residential development in Te Kauwhata. The structure plan proposes the rezoning of some land, a revised road layout, stormwater management, infrastructure network development, ecological protection, provision of open space and walkways, development standards and urban design guidelines.

Notice of Requirement for Designation: The Waikato District Council also gives notice of its requirement for a designation for a public work. The site and nature of the proposed work is a road corridor, approximately 2,540m long, between Te Kauwhata Road and Waerenga Road, including the construction, operation and maintenance of the road and all ancillary structures, works and activities associated with it, to provide a heavy traffic bypass of Te Kauwhata Village.

The effects that the public work will have on the environment include visual, archaeological, noise, construction, property, traffic, vegetation, ecological and floodplain effects. The ways in which any adverse effects will be mitigated are set out in the Notice of Requirement report including a set of proposed conditions suggested by the Requiring Authority.

Alternative sites, routes, and methods have been considered and the description of those alternatives are contained in the Notice of Requirement report.

The public work and designation are reasonably necessary for achieving the objectives of the Waikato District Council because the proposed road will ensure the long term safe functioning of the Te Kauwhata Structure Plan road network, in particular improved industrial traffic and through traffic flows. The proposed road will also improve the safety and amenity of businesses and residents along the urban length of Waerenga Road/Main Road and Te Kauwhata Road.

The following consultation has been undertaken with parties that are likely to be affected. Consultation meetings have been held with all landowners whose property is directly affected by the proposed road and the notes from those meetings are contained in the Notice of Requirement report. In addition, the proposed road has been discussed with tangata whenua, Ontrack, the Waikato Regional Council and the Asset Management Group within Waikato District Council. The Te Kauwhata community has also been consulted with respect to the proposed road through two Public Open Days in May and December 2008 and regular meetings of the Te Kauwhata Community Committee.

Submissions
Any person may make a submission on the variation or on the notice of requirement. You may do so by sending a written submission to the Waikato District Council, whose address is given below. The submission on the variation must be in Form 5. The submission on the notice of requirement must be in Form 21. Forms for this purpose may be obtained from any of the offices and libraries listed above, from the Council’s website or by e-mailing a request to districtplan@waidc.govt.nz Each submission must state whether or not you wish to be heard on your submission.

The process for public participation in the consideration of the variation is as follows:
· After the closing date for submissions, the Council must prepare a summary of the submissions and this summary must be publicly notified;
· There must be an opportunity to make a further submission in support of, or in opposition to, the submissions already made;
· If a person making a submission asks to be heard in support of his or her submission, a hearing must be held;
· Waikato District Council must give its decisions on the proposal (including its reasons for accepting or rejecting submissions);
· Any person who has made a submission has the right to appeal the decision on the proposal to the Environment Court.

The process for public participation in the consideration of the notice of requirement is as follows:
· After the closing date for submissions, a public hearing by an independent Commissioner will be held;
· The Commissioner will consider the requirement and any submissions received, and make his recommendation to the Council;
· The Council may decide to confirm the requirement, modify the requirement, impose conditions, or withdraw the requirement;
· Notice of the Council’s decision will be sent to those people who made a submission on the notice of requirement and to those landowners and occupiers who will be directly affected by the designation;
· Any person who has made a submission has the right to appeal the decision on the proposal to the Environment Court. Landowners and occupiers who will be directly affected by the designation do not have the right of appeal unless they make a submission on the notice of requirement.
