Amended Notice of Requirement for Designation - Te Kauwhata Bypass

The Waikato District Council has prepared the following amended notice of requirement to the Proposed Waikato District Plan.

Amended Notice of Requirement for Designation: The Waikato District Council gives amended notice of its requirement for a designation for a public work. The site and nature of the proposed work is a road corridor, approximately 2,540m long, between Te Kauwhata Road and Waerenga Road, including the construction, operation and maintenance of the road and all ancillary structures, works and activities associated with it, to provide a heavy traffic bypass of Te Kauwhata Village. The Notice of Requirement for Designation has been amended from that which was notified in October 2009 to take into account additional investigations into geotechnical stability and stormwater disposal along the route. As a result the road corridor identified in the Notice of Requirement for Designation is wider than that originally notified.

The effects that the public work will have on the environment include visual, noise, construction, property, traffic, vegetation, ecological and floodplain effects. The ways in which any adverse effects will be mitigated are set out in the Notice of Requirement report including a set of proposed conditions suggested by the Requiring Authority.

Alternative sites, routes, and methods have been considered and the description of those alternatives is contained in the Notice of Requirement report.

The public work and designation are reasonably necessary for achieving the objectives of the Waikato District Council because the proposed road will ensure the long term safe functioning of the Te Kauwhata road network, in particular improved industrial traffic and through traffic flows. The proposed road will also improve the safety and amenity of businesses and residents along the urban length of Waerenga Road/Main Road and Te Kauwhata Road.

The following consultation has been undertaken with parties that are likely to be affected. Consultation meetings have been held with all landowners whose property is directly affected by the proposed road and the notes from those meetings are contained in the Notice of Requirement report. In addition, the proposed road has been discussed with tangata whenua, the New Zealand Transport Agency, Ontrack, the Waikato Regional Council and the Asset Management Group within Waikato District Council. The Te Kauwhata community has also been consulted with respect to the proposed road through two Public Open Days in May and December 2008 and regular meetings of the Te Kauwhata Community Committee.

Making a Submission
If you wish to make a submission you may do so by sending a written submission to the Waikato District Council, Private Bag 544, Ngaruawahia, fax 07 824 8091, no later than 5pm on Wednesday 31 March 2010. The submission must be dated, signed by you and include the following information:
1. Your name, postal address, telephone number and fax number (if applicable).
2. Those aspects of the Notice of Requirement in respect of which you are making the submission.
3. Whether you support or oppose the Requirement in whole or in part.
4. Your submission with reasons.
5. The recommendation you wish the Waikato District Council to make.
6. Whether you wish to be heard in support of your submission.

A copy of your submission must be served as soon as reasonably practicable on Waikato District Council at the address for service stated below.

The process for public participation in the consideration of the notice of requirement is as follows:
After the closing date for submissions, a public hearing by an independent Commissioner will be held;
The Commissioner will consider the requirement and any submissions received, and make his recommendation to the Council;
The Council may decide to confirm the requirement, modify the requirement, impose conditions, or withdraw the requirement;
Notice of the Council’s decision will be sent to those people who made a submission on the notice of requirement and to those landowners and occupiers who will be directly affected by the designation;
Any person who has made a submission has the right to appeal the decision on the proposal to the Environment Court. Landowners and occupiers who will be directly affected by the designation do not have the right of appeal unless they make a submission on the notice of requirement.
